On May 8, Niantic made some minor changes to Pokémon Go’s terms and conditions. Despite this, fans have been carefully reading them and have found several points that worry them, including the clause that states that event schedules and content are subject to change at any time without prior notice or payment.

“Subject to applicable law, all schedules and any live or in-game experiences, activities, goods, services, perks, items, rewards, and content advertised in connection with an event are not guaranteed and are subject to change and/or cancellation at any time prior to or during an event without notice or compensation of any kind,” the section, which was already present long before the most recent update, states. Additionally, it states that although Niantic will use “commercially reasonable” efforts to alert fans in advance, the event’s date, time, and location are subject to change at any time and that no one will be reimbursed for travel or lodging expenses; only ticket purchases will be eligible for a refund. Pokémon fans who read this section understood nothing is truly set in stone. They worry that something negative might occur at the event—or any other event in the future, for that matter—and that they would be powerless to prevent it.

Another worry is that refusing to participate in some data collection agreements may make it difficult to participate in other online activities. Two additional items that fans noticed in the TOS have them worried.

The first contains a section on content ownership that the players believe is directed at irate fans who are creating memes about the mobile game.

The second requires players unless they choose to opt out, to arbitrate their legal disputes with Niantic on an individual basis rather than through a jury trial or a class action. Again, none of these terms of service clauses are particularly novel, but now that players of Pokémon Go have actually read them, they are raising red flags.
