When Epic Games sued Apple, the company that created iOS, for preventing it from making as much money on store sales, it was taking on a titan. Since Apple was dictating the amount of money developers could expect to make from sales across a variety of apps, according to Epic, this was evidence of a monopoly. The Ninth Circuit has largely rejected an appeal following a prior defeat. Epic might have to pay after losing the most recent appeal in the case against Apple.

According to Axios reporter Stephen Totilo today, the court largely upheld the previous decision, with Epic losing the majority of the claims it made. Many people anticipated this outcome, as the court upheld the majority of the earlier judgments. If that is enforced, Epic is probably able to cover the legal costs without depleting its savings, so it appears that the only thing that might be hurt is Epic’s pride. The tweets of CEO Tim Sweeney, who confirmed the verdict in the case and acknowledged Epic had not made its case, did not make this clear.

Users could theoretically use the Google Play Store on iOS devices or the Apple App Store on Android after the changes are implemented by their 2024 deadline. However, it also makes it possible for other businesses to start their own app stores. This suggests that Fortnite may finally make a formal comeback on iOS devices. Apple responded by removing the Fortnite app and closing Epic Games’ developer accounts after Epic Games added a direct payment method to Fortnite on Apple devices in August 2020 that avoided the App Store’s fees.

However, even if laws like these are passed, Fortnite on iOS might not come back. The part of the EU’s Digital Markets Act that would allow developers to install their own third-party payment systems, which initially sparked the conflict between Epic and Apple, has not yet received Apple’s approval, according to the Bloomberg report. However, the passage of laws like the Digital Markets Act is just the beginning of what might be Fortnite’s long-awaited return to iOS.

It is unknown if this will serve as the solution or if Epic has any other options. There will probably be a lot of interest from fans in whether Fortnite will return to the App Store, but Apple may decide to permanently ban it from its store. There is no way to know for sure, but it’s possible that iOS users may eventually see Fortnite return.
